Information about the New Minimum Wage Law

On November 8, 2006, Arizona voters passed a law to raise the state minimum wage.

When does the law go into effect?: January 1, 2007
What is the new state minimum wage?: $6.75
Will the minimum wage continue to go up?: Yes. Each January 1st there will be a cost of living increase.
Does an employee have the right to look at his/her payroll records?: Yes. Also, an employee can have another person, such as a parent, attorney or union representative, look at the employee’s payroll records.
Is there an agency where complaints that an employer is not paying the minimum wage can be filed?: Yes. Complaints can be filed with the Arizona Industrial Commission, 800 West Washington, Phoenix, AZ 85007
Are any employees not covered by the law?: Yes. Persons who baby-sit on a "casual" basis. Persons who are employed by a parent or sibling.
Are employees protected from retaliation if they complain about their wages?: Yes.
Does the law cover employees who receive tips?: Yes. For employees who receive tips, the employer can pay up to $3.00 less than the minimum wage per hour, if the employer keeps records to show the employee’s hourly wage plus tips equaled the minimum wage.
Does an employer have to post a notice about the state minimum wage law?: Yes.
Can an employee sue an employer to recover unpaid minimum wages?: Yes.

INFORMACION SOBRE LA NUEVA LEY DEL SALARIO MINIMO

Tiene el derecho un empleado de revisar sus archivos de pago?: Si. Tambien el empleado puede tener otra persona como un padre, abogado o representante de union que revise sus archivos de pago.
Existe una agencia donde se puede presentar quejas que un empleado no esta pagando el salario minimo?: Si. Quejas pueden ser presentadas con la Comision Industrial de Arizona 800 West Washington, Phoenix, AZ 85007
Existen empleados que no son protegidos por esta ley?: Si. Personas que cuidan a ninos en base "casual." Personas que son empleados por sus padres o hermanos.
Son protegidos empleados de vengansa si se quejan sobre su salario?: Si.
La ley tambien protégé empleados que reciben propinas?: Si. Para empleados que reciben propinas, el empleador puede pagar hasta $3.00 menos que el salario minimo por la hora, solamente si el empleador tiene archivos para mostrar que el salario por hora del empleado mas las propinas suman al salario minimo.
Un empleador debe establecer un aviso acerca la ley del salario minimo del estado?: Si.
Puede un empleado demandar a un empleador para recuperar salario minimo que no haiga sido pagado?: Si.
